Lawyer: California prosecutors could get Robert Durst now, if they want

NEW ORLEANS (AP) – A lawyer for real estate heir Robert Durst says Los Angeles County prosecutors could get custody of him immediately, rather than waiting until he’s moved to a federal prison in Indiana to serve time for a weapons conviction.

Attorney Dick DeGuerin says they could do so by asking a California judge for a habeas corpus warrant for Durst’s prosecution.

Los Angeles prosecutor John Lewin won’t comment. He says he doesn’t talk to reporters about active cases.

Durst is serving seven years after pleading guilty in New Orleans to a federal weapons charge. He’s charged in Los Angeles with murder. Durst has said he’s innocent, and wants to prove it.

DeGuerin says he probably won’t get advance notice of the move to the prison in Terre Haute.
